These Terms of Service ("Terms") govern your access to and use of the Hoard iOS application and related services (together, the "Service"), operated by Jack Hurley ("Hoard", "we", "us", or "our").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Hoard (or the minimum age required in your country). If you are under the age of majority in your jurisdiction, you confirm that your parent or legal guardian has agreed to these Terms on your behalf.
2. Your account
- You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
- You must provide accurate information when signing up.
- You must not share your account with anyone else or impersonate another person.
- You can delete your account at any time from Settings → Delete Account, or by emailing us.
3. How Hoard works
Hoard lets you save links to publicly available social media content (TikTok, Instagram, YouTube, Facebook, X/Twitter, and other supported platforms). Hoard retrieves publicly available metadata and content from those links and uses AI to produce summaries, insights, and actionable outputs such as recipes, workouts, or itineraries.
Important:
- You grant Hoard a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display the content you save, solely for the purpose of providing the Service to you.
- You retain ownership of the AI-generated outputs produced for your account. You may export or delete them at any time.
- Hoard does not own or license the original content on third-party platforms. The original creators retain all rights to their work.
4. Acceptable use
You agree not to use the Service to:
- Save or process content that is illegal, infringes intellectual property rights, is defamatory, harassing, hateful, or sexually explicit involving minors.
- Attempt to scrape, reverse-engineer, decompile, or otherwise extract source code or non-public data from the Service.
- Abuse, overload, or probe the Service or its infrastructure, including bypassing rate limits.
- Use Hoard to train competing AI models or redistribute AI outputs as if they were your own work product sold at scale.
- Violate any applicable law or the terms of any third-party platform whose content you save.
We may suspend or terminate accounts that violate these rules.
5. Subscription, payment, and refunds
- Hoard offers a free tier and paid premium subscription tiers.
- Payments are processed through Apple's In-App Purchase system. Apple's terms and privacy policy apply.
- Subscriptions automatically renew until cancelled through your Apple ID settings. You can cancel at any time; access continues until the end of the current billing period.
- Refunds are handled by Apple per Apple's standard refund policy.
- We may change subscription pricing or introduce new tiers with reasonable notice.
6. AI output disclaimers
Hoard's AI features produce summaries, insights, and suggestions. These are informational only and may contain errors.
- Not professional advice. Hoard does not provide medical, legal, financial, safety, or nutritional advice. Consult a qualified professional where appropriate.
- Accuracy. AI outputs may misrepresent the underlying content, omit important context, or produce incorrect information. You are responsible for verifying any AI output before acting on it.
- Third-party content. Hoard processes content we don't own. We cannot guarantee that content retrieved from public URLs is accurate, safe, or lawful.
7. Third-party services
Hoard relies on third-party providers (including Supabase, Anthropic, OpenAI, Apify, RevenueCat, Sentry, PostHog, and Apple) to deliver the Service. Those providers have their own terms and privacy practices, described in our Privacy Policy.
8. Availability, changes, and discontinuation
- We try to keep Hoard available and working, but we do not guarantee uninterrupted service. The Service is provided "as is" and "as available".
- We may change, suspend, or discontinue any part of the Service at any time.
- If we make material changes that disadvantage paying subscribers, we will give reasonable notice and, where required, a pro-rata refund.
9. Intellectual property
The Hoard name, logo, UI, code, and all related materials are owned by Jack Hurley. Your content remains yours.
10. Termination
- You may stop using Hoard and delete your account at any time.
- We may suspend or terminate your account if you materially breach these Terms.
- On termination, your right to use the Service ends. Sections that by their nature should survive termination will survive.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.
12. Limitation of liability
To the maximum extent permitted by law, Hoard will not be liable for any indirect, incidental, special, consequential, or punitive damages. Hoard's total liability will not exceed the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms limits any rights you have under Australian Consumer Law or other non-excludable consumer protection laws.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute will be resolved in the courts of New South Wales, except where mandatory consumer protection laws in your country require otherwise.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app before they take effect.
